AMENDING RESOLUTION NO. 506 FOR 2017 BY RESCINDING THE CONVEYANCE OF 343 FIRST STREET (TAX MAP NO. 65.56-3-61) IN THE CITY OF ALBANY AND AUTHORIZING THE CONVEYANCE OF THIS PROPERTY TO ANOTHER GRANTEE

By Audit and Finance Committee:
WHEREAS, By Resolution No. 506 for 2017, this Honorable Body authorized the conveyance of various parcels of real property acquired by the County through “in rem” delinquent tax foreclosure to the Albany County Land Bank Corporation including 343 First Street (Tax Map No. 65.56-3-61) in the City of Albany, and
WHEREAS, Due to confusion as to ownership of 343 First Street resulting from the Land Bank not taken record title to it as authorized by Resolution No. 506 of 2017, this property was erroneously deeded by a third party to Juan D. Albarracin thereby resulting in a title dispute between himself and the County, which dispute he is agreeable to resolving by his paying the County all expenses it has incurred with respect to this property in return for the County giving him a Quitclaim Deed to this property, and
WHEREAS, Under the circumstances it is in the best interest of the County to convey this property to Juan D. Albarracin and thereby recoup all the delinquent taxes and out of pocket expenses incurred by the County with respect to it amounting to $20,328.14 now, therefore, be it
RESOLVED, By the Albany County Legislature, that Resolution No. 506 for 2017 is hereby amended by rescinding the authorization to convey 343 First Street (Tax Map No. 65.56-3-61) in the City of Albany to the Albany County Land Bank Corporation, and be it further
RESOLVED, That the County Executive is authorized to execute on behalf of the County any documents necessary to convey 343 First Street (Tax Map No. 65.56-3-61) in the City of Albany to Juan D. Albarracin, 174 Ridge Street, Newark, New Jersey, 07104 for the amount of all delinquent taxes and out of pocket expenses amounting to $20,328.14 incurred by the County with respect to this property in return for the County giving him a Quitclaim Deed to the property and, be it further
RESOLVED, That Juan D. Albarracin shall be responsible for all closing costs and the 2023 Property Tax Bill for 343 First Street, and be it further
RESOLVED, That the County Attorney is authorized to approve said conveyance as to form and content, and, be it further
RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
