RESOLUTION NO. 85

 

DETERMINATION THAT THE ASBESTOS ABATEMENT AND DEMOLITION OF 1538 NEW SCOTLAND ROAD IN SLINGERLANDS WILL NOT HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT

 

                     Introduced:  3/9/20

                     By Public Works Committee:

 

WHEREAS, The Commissioner of  the Department of Public Works (the “Department”) has indicated that it is in the best interests of the County of Albany to proceed with a project regarding the demolition and related asbestos abatement of a building located at 1538 New Scotland Road, Slingerlands NY, and

 

WHEREAS,  The Commissioner has further indicated that the Department will work to demolish the building located on the aforementioned property in order to repurpose the space as a contributing feature of the neighborhood alongside a section of the Albany County Helderberg-Hudson Rail Trail, and

 

                     WHEREAS, The Commissioner working in conjunction with the Senior Natural Resource Planner has determined that the project is properly classified as an “unlisted” action pursuant to the regulations found under the State Environmental Quality Review Act (“SEQRA”), and

 

                     WHEREAS, Under Part 617 of Title 6 of the New York Code of Rules and Regulations, in light of the project’s designation as an “unlisted” action, the Senior Natural Resource Planner has conducted an uncoordinated review and has recommended that Albany County make a determination regarding the potential environmental impact of the project, and

 

                     WHEREAS, The Senior Natural Resource Planner has completed a short environmental assessment as required by SEQRA and has considered various impacts and implications that the project may have on the environment, and

 

                     WHEREAS,   Through the aforementioned SEQRA analysis the Department and the Senior Natural Resource Planner have received comments from the New York State Department of Parks, Recreation and Historic Preservation which confirm    that the building which will be demolished is a non-contributing resource to the historic district it is located in due to numerous previous alterations to the building and the associated loss of its historic integrity, now, therefore be it

 

RESOLVED, By the Albany County Legislature that this Honorable Body has considered the findings contained within the short Environmental Assessment and, pursuant to SEQRA, hereby determines that the aforementioned project will not have a significant impact on the environment and is therefore properly classified as a “unlisted” action with a negative declaration, and, be it further

 

RESOLVED, That the Chair of the Legislature is hereby authorized and directed to sign and file any documents that may be necessary to comply with SEQRA regarding the Project, and, be it further

 

                     RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
