RESOLUTION NO. 393

 

AUTHORIZING A CUSTOMER PROJECT COMMITMENT AGREEMENT WITH THE NEW YORK POWER AUTHORITY REGARDING THE STREETLIGHT CONVERSION PROJECT

By Public Works Committee and Mr. Miller:

 

                     WHEREAS, By Resolution No. 126 for 2019, this Honorable Body authorized

a five-year Energy Services Program Master Cost Recovery Agreement with the New York Power Authority (NYPA) as a preliminary action necessary for the implementation of an aggregated streetlight conversion program and the associated purchase of streetlights and the installation of LED lighting in Albany County, and

 

                     WHEREAS, By Resolution No. 259 for 2019, this Honorable Body authorized an agreement with NYPA regarding an authorization to proceed with the development phase of this project, and

 

                     WHEREAS, By Resolution No. 494 for 2020, this Honorable Body authorized the initial Customer Project Commitment with NYPA for the purchase and conversion of approximately 105 County-owned streetlights throughout Albany County to new energy efficient LED streetlights in the amount of $272,774 for a term commencing December 17, 2020 and ending April 14, 2024, and

 

                     WHEREAS, The County Executive has requested authorization to enter into a  subsequent Customer Project Commitment agreement with NYPA for the maintenance of 130 County-owned streetlights throughout Albany County  in amounts not to exceed $3,042 annually for routine maintenance and $8,505 annually for non-routine maintenance for a term commencing November 15, 2021 and ending November 14, 2023, and

 

                     WHEREAS, The County Executive has indicated that routine maintenance consists of replacing and repairing defective components of the street lighting system to keep them fully operational, while the non-routine maintenance includes repairs that go above and beyond the routine repairs and requires the approval of the County before work is completed, and

 

                     RESOLVED, By the Albany County Legislature that the County Executive is authorized to enter into a subsequent Customer Project Commitment agreement with NYPA, White Plains, NY  10601, for the maintenance of 130 County-owned streetlights throughout Albany County in amounts not to exceed $3,042 annually for routine maintenance and $8,505 annually for non-routine maintenance for a term commencing November 15, 2021 and ending November 14, 2023, and, be it further

 

RESOLVED, That the County Attorney is authorized to approve said agreement as to form and content, and, be it further

 

                     RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
