RESCINDING THE CONVEYANCE OF REAL PROPERTY PURSUANT TO RESOLUTION NO. 271 FOR 2018 AND AUTHORIZING THE CONVEYANCE OF REAL PROPERTY LOCATED AT 139 LARK STREET (TAX MAP NO. 65.72-4-29) IN THE CITY OF ALBANY

By Audit and Finance Committee:

 

WHEREAS, By Resolution No. 271 for 2018, this Honorable Body authorized the conveyance of various parcels of real property acquired through “in rem” foreclosure to the Albany County Land Bank Corporation (“Land Bank”), including 139 Lark Street (Tax Map No. 65.72-4-29) in the City of Albany, and

 

WHEREAS, 139 Lark Street LLC has expressed an interest in acquiring the parcel and has offered to pay $17,000 for the property, with plans to develop it to have a positive impact on the community, and

 

WHEREAS, The Albany County Real Property Disposition Plan, adopted by Resolution No. 29 for 2019, implemented procedures for properties to be discretionally conveyed by the County to individuals or entities for economic development purposes, now, therefore, be it

 

RESOLVED, By the Albany County Legislature, that Resolution No. 271 for 2018 is hereby amended by rescinding the authorization to convey the parcel located at 139 Lark Street (Tax Map No. 65.72-4-29) in the City of Albany, and, be it further

 

RESOLVED, That the County Executive is authorized to execute on behalf of the County any documents necessary to convey the parcel located at 139 Lark Street (Tax Map No. 65.72-4-29) in the City of Albany to 139 Lark Street LLC, 63 State Street, Albany, NY 12207 for the amount of $17,000, and, be it further

 

RESOLVED, That 139 Lark Street LLC shall be responsible for any and all closing costs, as well as a pro-rated share of any current real property taxes owes as of the closing date, and, be it further

 

RESOLVED, That the County Attorney is authorized to approve said conveyance as to form and content, and, be it further

 

RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
