RESOLUTION NO. 232

 

AUTHORIZING THE CONVEYANCE OF A PARCEL OF REAL PROPERTY LOCATED AT 20 HARRIS AVE. (TAX MAP NO. 168.11-3-23.2) IN THE TOWN OF COEYMANS

By Audit and Finance Committee:

 

WHEREAS, The County of Albany has acquired through “in rem” foreclosure title to a parcel of real property located at 20 Harris Ave. (Tax Map No. 168.11-3-23.2) in the Town of Coeymans, and

 

WHEREAS, The Village of Ravena has expressed an interest in acquiring the parcel for $250, and has voluntarily maintained the lot for the past 15 years, and

 

WHEREAS, The Village intends to construct a stormwater pond on the parcel to alleviate flooding issues as it is located within a 100-year floodplain, and

 

WHEREAS, By Resolution No. 141 for 2025, this Honorable Body adopted an Updated Disposition Plan for Real Property Acquired through the In Rem Delinquent Tax Foreclosure Process, and

 

WHEREAS, § 360-41(d) of the Updated Disposition Plan allows for properties to be sold to other municipal corporations for use for a governmental purpose, provided, however, that such municipal corporation shall be required to agree to accept liability for any potential “surplus proceeds” as set forth in RPTL §§ 1196 and 1197(2)(a)-(b), and that the County shall thereby be released from liability for any payments related to “surplus proceeds” as a condition of sale, now, therefore, be it

 

RESOLVED, By the Albany County Legislature that the County Executive is authorized to execute on behalf of the County any and all documents necessary to convey property located at 20 Harris Ave. (Tax Map No. 168.11-3-23.2) in the Town of Coeymans to the Village of Ravena, New York, for $250, provided, however, that the Village of Ravena shall further be required to agree to accept liability for any potential “surplus proceeds” as set forth in RPTL §§ 1196 and 1197(2)(a)-(b) as a condition of sale, and that the County shall thereby be released from liability for any payments related to “surplus proceeds”, and, be it further

 

RESOLVED, That the Village of Ravena shall be responsible for all closing costs at the time of closing, and, be it further

 

RESOLVED, That the County Attorney is authorized to approve said conveyance as to form and content, and, be it further

 

RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
