AUTHORIZING A SUPPLEMENTAL AGREEMENT WITH MJ ENGINEERING AND LAND SURVEYING, P.C. REGARDING EXPANDED DESIGN SERVICES FOR THE ALBANY COUNTY RAIL TRAIL OVER NEW SCOTLAND ROAD (NYS 85) BRIDGE REPLACEMENT PROJECT

WHEREAS, By Resolution No. 455 for 2018, this Honorable Body authorized an agreement with MJ Engineering and Land Surveying, P.C. regarding design and construction inspection services for the Albany County Rail Trail over New Scotland Road (NYS 85) Bridge Replacement Project in the amount of $95,500, and
WHEREAS, By Resolution No. 82 for 2019, this Honorable Body authorized amendments to Resolution No. 455 for 2018 to provide for emergency design and inspection services in the amount of $24,000, and to fund the State Environmental Quality Review (SEQR) Type I analysis for the project in the amount of $9,000 for a total amount of $128,500 rather than $95,500, and
WHEREAS, By Resolution No. 322 for 2019, this Honorable Body authorized a supplemental agreement with MJ Engineering and Land Surveying, P.C. regarding the expansion of design services for the Albany County Rail Trail over New Scotland Road (NYS 85) Bridge Replacement Project in the amount of $31,000 for a total contract amount of $159,500 rather than $128,500, and
WHEREAS, By Resolution No. 86 for 2020, this Honorable Body authorized a supplemental agreement with MJ Engineering and Land Surveying, P.C. in order to expand the scope of the project to include ten additional weeks of construction inspection services and capacity analysis for the temporary detour and intersection modifications for the Albany County Rail Trail over New Scotland Road (NYS 85) Bridge Replacement Project in the amount of $53,500 for a total contract amount of $213,000 rather than $159,500 for a term commencing April 1, 2020 and ending September 30, 2021, and
WHEREAS, The Commissioner of the Department of Public Works has requested authorization to enter into an additional supplemental agreement with MJ Engineering and Land Surveying, P.C. in order to expand the design scope of the project for the Albany County Rail Trail over New Scotland Road (NYS 85) Bridge Replacement Project in the amount of $71,700, for a total contact amount of $284,700 rather than $213,000 for a term commencing June 1, 2022 and ending December 31, 2023, and
WHEREAS, Construction inspection fees incurred as part of the drainage improvement work along State Route 85 will be reimbursed to the County in an amount not to exceed $20,000, now, therefore, be it
RESOLVED, By the Albany County Legislature that the County Executive is authorized to enter into a supplemental agreement with MJ Engineering and Land Surveying, P.C., Clifton Park, NY 12065 in order to expand the scope of the aforementioned project to include four additional weeks of construction inspection services and capacity analysis for the temporary detour and intersection modifications for the Albany County Rail Trail over New Scotland Road (NYS 85) Bridge Replacement Project in the amount of $71,700 for a total contract amount of $284,700 rather than $213,000 for a term commencing June 1, 2022 and ending December 31, 2023, and, be it further
RESOLVED, That the County Attorney is authorized to approve said agreement as to form and content, and, be it further
RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
