AUTHORIZING THE CONVEYANCE OF REAL PROPERTY LOCATED AT 75 CLINTON AVENUE (TAX MAP NO. 65.82-4-40) AND 77 CLINTON AVENUE (TAX MAP NO. 65.82-4-41) IN THE CITY OF ALBANY

By Audit and Finance Committee:

 

WHEREAS, The County of Albany has acquired through “in rem” foreclosure title to two parcels of real property located at 75 Clinton Avenue (Tax Map No. 65.82-4-40) and 77 Clinton Ave (Tax Map No. 65.82-4-41) in the City of Albany, and

 

WHEREAS, The estate of the immediate former owner of the property, Benjamin Garland, has expressed an interest in reacquiring the parcels of real property located at 75 Clinton Avenue (Tax Map No. 65.82-4-40) and 77 Clinton Ave (Tax Map No. 65.82-4-41) in the City of Albany, and resolving litigation regarding said parcels, and

 

WHEREAS, The estate of Benjamin Garland and the County of Albany have agreed to a stipulation agreement to resolve all litigation regarding these parcels and  return them to the estate of Benjamin Garland upon payment of $200,000 to Albany County, and

 

WHEREAS, The Albany County Real Property Disposition Plan, adopted by Resolution No. 29 for 2019, implemented procedures for properties to be sold to immediate former owners, including that any and all liens extinguished as a result of the foreclosure must be reinstated, now, therefore, be it

 

RESOLVED, By the Albany County Legislature, that the County Executive is authorized to execute on behalf of the County any and all documents necessary to convey the two parcels of real property located at 75 Clinton Avenue (Tax Map No. 65.82-4-40) and 77 Clinton Ave (Tax Map No. 65.82-4-41) in the City of Albany to the estate of the immediate former owner of the property, Benjamin Garland for the amount of $200,000, and, be it further

 

RESOLVED, That such conveyances shall fully comport with the terms and conditions of the stipulation agreement entered into by the estate of Benjamin Garland and Albany County, and that this agreement shall resolve all litigation regarding these parcels, and, be it

 

RESOLVED, That the County Attorney is authorized to approve said conveyances as to form and content, and, be it further

 

RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
