DESCRIPTION OF REQUEST: (state briefly why legislative action is requested)

Ms. Kimberly Cuva, the Receiver of Tax for the Town of Colonie, has submitted an Applications for Corrected Tax Roll to correct an erroneous 2026 property tax bill issued for 41 Tull Drive, Town of Colonie, Tax Map Identification No. 41.8-4-18.

 

The owner of 411 Tull Drive paid their school tax bill to the Albany County Division of Finance on December 3, 2025.  However, due to a clerical error as defined by NYS RPTL §550 (2) (h) the payment was not applied to the property’s school tax bill.  This error was brought to the attention of Ms. Cuva after the paid school tax was incorrectly included on the 2026 property tax bill. This error is a Clerical Error as defined by NYS RPTL §550 (2) (h).

 

Real Property Tax Law §554 allows for the correction of clerical errors made on the assessment and tax rolls.  I recommend that the Albany County Legislature approve the correction of the tax rolls and authorize a corrected bill in the amount of $1,091.64.
