REQUESTING THE DEPARTMENTS OF MENTAL HEALTH AND SOCIAL SERVICES TO REPORT TO THE ALBANY COUNTY LEGISLATURE REGARDING SUBSTANCE USE DISORDER OPIOID TREATMENT FACILITIES LOCATED WITHIN ALBANY COUNTY

WHEREAS, Substance Use Disorder (SUD) Opioid Treatment Facilities (OTC) have been located in the County of Albany and in particular, the City of Albany, and
WHEREAS, The NYS Office of Addiction Services and Supports (OASAS) is required to coordinate with the Albany County Department of Mental Health for any approvals for these treatment facilities, and
WHEREAS, The location of these facilities may result in a cost to local municipal and County services including, police, EMS, medical and social services, and
WHEREAS, There is no publicly available census of the number of SUD/OTC’s in Albany County, the number of individuals who are and have been treated in SUD /OTC’s in Albany County and whether those individuals’ receiving treatment reside in Albany County or are person having come for treatment from other Counties, and
WHEREAS, There is no publicly compiled information regarding the number of individuals who are receiving treatment in OTCs in Albany County who have been required by Court Order to participate in SUD OTCs, and
WHEREAS, There is no publicly compiled information regarding the post-treatment residency status of individuals who have received treatment at SUD/OTCs located within Albany County, and
WHEREAS, the Albany County Department of Mental Health is well positioned to access all requested information and to compile a study related thereto, and
WHEREAS, In order to assess the need for further legislation regarding the continued siting and location of SUD/OTC facilities in Albany County and to assess any associated public safety concerns, the Albany County Legislature is seeking a joint study by the Albany County Department of Mental Health in coordination with the Albany County Department of Social Services, now, therefore, be it
RESOLVED, By the Albany County Legislature that a survey must be conducted by the Albany County Department of Mental Health in coordination with the Albany County Department of Social Services to be completed by October 31, 2026 and a written report must be made to the Health and Social Services Committees of the Albany County Legislature by the Commissioners of the Albany County Department of Mental Health and the Albany County Department of Social Services by November 30, 2026 which provides the following:
A list and location of each SUD and OTC operation in Albany County and the other regional counties in NYS (Rensselaer, Columbia, Washington, Greene, Saratoga, Schenectady, Montgomery and Warren) with dates each facility began operating to provide services;
A list and location of all homeless shelters in Albany County and the date each facility began operating to provide services
A list of SUD/OTC homeless shelters in the neighboring adjacent Counties including, Rensselaer, Columbia, Washington, Greene, Saratoga, Schenectady, Montgomery and Warren.
The number of individuals entering treatment at each SUD/OTC in Albany County for the years 2022-2025:
The number of individuals who successfully completed treatment for the years 2022,2023,2024 and 2025;
The number of individuals who left the SUD/OTC without successfully completing treatment and who did not have a permanent address in Albany County for the years 2022-2025;
The number of individuals who left the SUD/OTC and did not return to their permanent address after leaving treatment;
The number of overdose calls reported by Albany County law enforcement and first responders for 2022-2025 and provide a trend analysis for these years regarding the number of overdose calls received and the location for those calls;
Compile a location overlay map of the location of each SUD/OTC and homeless shelter in Albany County;
Compile a location overlay map of the location of each SUD/OTC and homeless shelter in each of the neighboring/adjacent regional Counties;
For 2022-2025 by each survey year, provide the total number of participants in SUD/OTC facilities in Albany County and the City of Albany. For treatment facilities in either Albany County and the City of Albany provide data including, the number and percentage of program participants who were mandated for treatment at a SUD/OTC by a drug court of any other County or municipality, and; the number of participants who are a volunteer participant in the program;
For 2022-2025 and for each survey year, prepare an analysis of the number of participants of each SUD/OTC facility and/or homeless shelter in Albany County and the City of Albany to provide the number of those participants to successfully complete their treatment plan.

RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
