DECLARING A PORTION OF BLODGETT HILL ROAD IN THE TOWN OF COEYMANS NO LONGER NECESSARY FOR PUBLIC USE

By Audit and Finance Committee:
WHEREAS, CR 103, also known as Blodgett Hill Road in the Town of Coeymans, is owned by the County of Albany, and
WHEREAS, A section of CR 103 totaling +0.25 acres, located adjacent to Blodgett Hill Road (Tax Map No. 142.-1-24.31) is no longer used or maintained by the County of Albany, and
WHEREAS, Pursuant to Highway Law §118-A, when a portion of land is no longer used for highway purposes in a County, said County may abandon said portion of land to an abutting owner, and
WHEREAS, Pursuant to § 65-3 of the Albany County Code, a parcel of real property owned by the County of Albany shall be deemed “no longer necessary for public use” prior to any conveyance of said real property, now, therefore, be it
RESOLVED, By the Albany County Legislature, that a portion of CR 103 in the Town of Coeymans totaling +0.25 acres, and as indicated of the surveyor’s description annexed hereto, is hereby declared abandoned pursuant to Highway Law §118-A, and, be it further
RESOLVED, The pursuant to County Law § 215 and § 65-3 of the Albany County Code, the Albany County Legislature hereby declares that that a portion of CR 103 in the Town of Coeymans, totaling +0.25 acres and as indicated on the surveyor’s description annexed hereto, is deemed “no longer necessary for public use” and, be it further
RESOLVED, That the County Attorney is authorized to approve said document as to form and content, and, be it further
RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
SCHEDULE A
ALL that certain lot, piece or parcel of land, situate, lying and being in the Town of Coeymans, County of Albany, and State of New York, more particularly bounded and described as follows:
BEGINNING at a point in the southerly line of the relocated Albany County Route 103 a/k/a Blodgett. Hill Road at its intersection with the northwesterly corner of the premises herein described and the northeasterly corner of other lands of the County of Albany; thence turning and running from said point on a bearing of S 41° 33' 01" E a distance of 79.57 feet to an iron rod set; thence turning and running from said point on a bearing of S 61° 02' 43" E a distance of 99.21 feet to an iron rod set in the southwesterly corner of the premises herein described; thence turning and running from said point on a bearing of N 52° 50' 15" E a distance of 60.01 feet to an iron rod set in the southeasterly corner of the premises herein described; thence turning and running from said point on a bearing of N 61° 02' 43" W a distance of 98.72 feet to an iron rod set; thence continuing on a bearing of N 41° 33' 01" W a distance of 97.86 feet to an iron rod set in the northeasterly corner of the premises herein described, and the southerly line of the aforesaid Albany County Route 103 a/k/a Blodgett Hill Road; thence turning and running from said point and along the southerly line of Albany County Route 103 a/k/a Blodgett Hill Road on a bearing of S 36° 00' 20" W a distance of 61.44 feet to the point and place of beginning, containing 0.25 acres of land, more or less.
