AMENDING RESOLUTION NO. 74 FOR 2022, AS AMENDED, REGARDING THE THIRD COUNSEL AT FIRST APPEARANCE GRANT AND AMENDING THE 2025 PUBLIC DEFENDER'S OFFICE BUDGET

WHEREAS, By Resolution No. 74 for 2022, this Honorable Body authorized an agreement with the New York State Office of Indigent Legal Services regarding the Third Counsel at First Appearance Grant in the amount of $749,700 for the term commencing January 1, 2020 and ending December 31, 2022, and
WHEREAS, By Resolution No. 216 for 2023, this Honorable Body authorized an amendment to the aforementioned agreement to amend the term to reflect an ending date of December 31, 2024, and
WHEREAS, By Resolution No. 70 for 2025, this Honorable Body authorized an additional amendment to the aforementioned agreement to amend the term to reflect an ending date of December 31, 2025, and
WHEREAS, The Public Defender has requested to further amend the agreement with the New York State Office of Indigent Legal Services to reflect an additional $247,340 in funding, and
WHEREAS, The Public Defender has also requested to amend the 2025 Public Defender’s Office Budget in order to appropriate the additional funding, now, therefore, be it
RESOLVED, By the Albany County Legislature that Resolution No. 74 for 2022, as amended, is hereby further amended to reflect an additional $247,340 for a new total amount of $997,040, and, be it further
RESOLVED, That the 2025 Public Defender’s Office Budget is amended as follows:
Increase Revenue Account A1170 0 3337 Counsel at 1st Appearance by $247,340
Increase Appropriation Account A1170.1 by $247,340 by increasing Line Item A1170 1 9954 Enhanced Pay by $247,340
and, be it further
RESOLVED, That the County Attorney is authorized to approve said amendment as to form and content, and, be it further
RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
