DESCRIPTION OF REQUEST: (state briefly why legislative action is requested)
Mr. Tim Ryan, Superintendent of the Town of Colonie Division of Pure Waters, has submitted an Application for Refund or Credit of Real Property Taxes to correct an erroneous 2026 property tax bill issued to 886 Watervliet Shaker Rd, Town of Colonie, Tax Map Identification No. 30.-2-10.1
The owner of 886 Watervliet Shaker Rd was incorrectly assessed for sewer charges that was attributable to other parcels. The property was vacant and there should not have been any sewer charges assessed in 2026. This error was brought to the attention of Mr. Ryan after the bill was paid. This error is a Clerical Error as defined by NYS RPTL §550 (2) (e).
Real Property Tax Law §556 allows for the correction of clerical errors and the refund of any overpayment. I recommend that the Albany County Legislature approve the correction of the erroneous tax bill and authorize a refund in the amount of $5,008.98.
