AMENDING RESOLUTION NO. 788 FOR 2024 REGARDING THE ALLOCATION OF AMERICAN RESCUE PLAN ACT STATE AND LOCAL FISCAL RECOVERY FUNDS FOR THE TRANCHE 1 REVENUE REPLACEMENT PROJECT AND AMENDING THE 2025 ALBANY COUNTY BUDGET

By Audit and Finance Committee:
WHEREAS, The County of Albany received $29,515,880 in funds from the American Rescue Plan Act (ARPA) regarding the State and Local Fiscal Recovery Funds program for revenue replacement related to expenses for Albany County employees, and
WHEREAS, By Resolution No. 788 for 2024, this Honorable Body authorized the obligation of said funds in the amount of $29,515,880 over three years, with $9,838,627 of the $29,515,880 for fiscal year 2024, $9,838,627 in 2025, and $9,838,626 in 2026, and
WHEREAS, The Commissioner of the Department of Management and Budget has requested authorization to amend Resolution No. 788 for 2024 in order to amending the allocation to reflect $15,000,000 in 2024, $9,838,627 in 2025, and $4,677,253 in 2026, and
WHEREAS, The Commissioner has indicated that such amendment is necessary to account for actual expenditures for these years, and
WHEREAS, The Commissioner has also requested that the Department of Management and Budget, along with the Office of Audit and Control, be granted the right to adjust which positions the revenue replacement funds are allocated to cover if actual expenditures for a position in a particular year are below the allocation indicated in the budget amendment, and that such flexibility is necessary to ensure that reporting to the U.S. Treasury complies with all reporting requirement under ARPA, and
WHEREAS, A budget amendment to the 2025 Albany County budget is necessary to accommodate said funding, now, therefore, be it
RESOLVED, By the Albany County Legislature that Resolution No. 788 for 2024 is hereby amended by replacing the spreadsheet annexed thereto with the spreadsheet annexed hereto, and, be it further
RESOLVED, That the Commissioner of the Department of Management and Budget, in partnership with the Office of Audit and Control, is hereby granted the authority to adjust which positions the revenue replacement funds are allocated to in the event that actual expenditures for a position in a particular year are below the allocation indicated in the budget amendment, in order to comply with all necessary ARPA reporting requirements to the U.S. Treasury, and, be it further
RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
