DESCRIPTION OF REQUEST: (state briefly why legislative action is requested)
The Department of Public Works is requesting Legislature authorization to adopt a resolution abandoning property more particularly identified as a portion of New York State Department of Transportation Map No. 109, Parcel No. 140, located adjacent to Tax Parcel No. 29.2-3-1 in the Town of Colonie, and authorizing ownership of the abandoned property to revert to the State of New York pursuant to the conditions set forth in Albany County Deed R2017-20980.
The property was originally acquired by the State of New York from Mr. George J. Clute as part of a road realignment project along Watervliet Shaker Road. The portion of the property proposed for abandonment is in excess of the land required to complete the project and is not needed for any Albany County purpose. Mr. Clute seeks to reacquire this property from the State of New York. To accomplish this, Albany County must first abandon its interest in the property so that ownership reverts to the State of New York in accordance with the deed restrictions. The property has no present or anticipated value to Albany County.
