AMENDING RESOLUTION NO. 389 FOR 2018 REGARDING the counsel at first appearance grant and amending the 2021 public defender’s office budget

WHEREAS, By Resolution No. 389 for 2018, this Honorable Body authorized an agreement with the New York State Office of Indigent Legal Services regarding the Counsel at First Appearance grant in the amount of $749,700 for a three-year term commencing June 1, 2017 and ending May 31, 2020, and
WHEREAS, The Alternate Public Defender’s Office, on behalf of the Public Defender and the Alternate Public Defender, has requested an amendment to the agreement with the New York State Office of Indigent Legal Services to reflect a term ending date of December 31, 2021 rather than May 31, 2020, and
WHEREAS, The Alternate Public Defender’s Office has also requested an amendment to the 2021 Public Defender’s Office Budget in order to utilize the remaining funds from the grant, now, therefore be it
RESOLVED, By the Albany County Legislature that Resolution No. 389 for 2018 is hereby amended to reflect a term ending date of December 31, 2021 rather than May 31, 2020, and, be it further
RESOLVED, That the 2021 Public Defender’s Office Budget is amended as follows:
Decrease Appropriation Account A1170.1 by $50,000 by decreasing Line Item A1170 1 2030 001 Arraignment Attorney by $50,000 with an annual salary of $17,626
Decrease Appropriation Account A1170.8 by $27,000 by decreasing the following line items:
Decrease Line Item A1170 8 9010 State Retirement by $10,062
Decrease Line Item A1170 8 9030 Social Security by $4,094
Decrease Line Item A1170 8 9060 Hospital and Medical Insurance by $12,844
Increase Appropriation Account A1170.1 by $77,000 by increasing Line Item A1170 1 9954 Enhanced Pay by $77,000
and, be it further
RESOLVED, That the County Attorney is authorized to approve said amendment as to form and content, and, be it further
RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
