Justification: (state briefly why legislative action is requested)

The Town of Colonie has requested that the County of Albany adopt a resolution which authorizes the correction of four hundred and sixty six (466) 2022 Town of Colonie Tax Bills.  The Town of Colonie made an error when determining the 2021 sewer units for the Sewer Benefit Roll.  Sewer units are determine by the water usage from meter readings in cubic feet divided by 27,000 gallons to determine the units charged with a minimum of 3 units per property.  When computing the unit numbers the wrong year of water usage was applied. 

These errors are a clerical error as defined by RPTL § 550 (2)(e).  RPTL § 556-b allows for the correction of certain errors that are substantial in number and identical in nature.  Upon my recommendation, and pursuant to RPTL § 550 & § 556-b, the Town of Colonie is requesting the correction of the erroneous tax bills. Four hundred and sixty six (466) properties were overcharged for their 2021 sewer usage.  Their 2022 bills need to be corrected, and the over payment refunded.  The Town of Colonie will be paying the refund.  The total amount to be refunded is $573,456.24.

Given the information provided, I am requesting that the County Legislature adopt a resolution authorizing the correction of the various 2022 Town of Colonie Tax Bill.  The resolution should clearly state the Town of Colonie will be paying the refund
