AUTHORIZING AN AGREEMENT WITH THE NEW YORK STATE DEPARTMENT OF TRANSPORTATION REGARDING CONSTRUCTION ON THE ALBANY COUNTY RAIL TRAIL OVER NEW SCOTLAND ROAD (STATE ROUTE 85)

WHEREAS, Authorizing construction work on drainage improvements as part of the Albany County Rail Trail over New Scotland Road (Route 85) on the State Highway System, the performance and funding in the first instance 100% of the costs of construction or reconstruction thereof, to be reimbursed by the State and appropriating funds therefore, and
WHEREAS, The State of New York has requested County of Albany to incorporate improvements (the “State Reverse Betterment") to work on drainage on Albany County Rail Trail over New Scotland Road (Route 85), now, therefore, be it
RESOLVED, By the Albany County Legislature, that the project inclusive of the State Reverse Betterment (collectively the "Project") is hereby approved, and, be it further
RESOLVED, That the Albany County Legislature hereby authorizes the County of Albany to pay in the first instance 100% of the costs of the Project or portions thereof, and, be if further
RESOLVED, That the sum of $320,000.00 will be appropriated and made available to cover the cost of participation in the Construction phase of the Project, and, be it further
RESOLVED, By the Albany County Legislature that the County Executive is authorized to execute all necessary agreements, certifications or reimbursement requests on behalf of County of Albany with NYSDOT in connection with the implementation of the Project, and reimbursement of the approved costs associated with the State Reverse Betterment, and, be it further
RESOLVED, That a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project, and, be it further
RESOLVED, That the County Attorney is authorized to approve said grant application as to form and content, and, be it further
RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials, and, be it further
RESOLVED, This Resolution shall take effect immediately.
