The Assessor for the Town of Guilderland, Ms. Heather Weinhold, has submitted three Application(s) for Refund or Credit of Real Property Taxes on behalf of Matthew Timony, owner of 6 Van Wie Ter, Town of Guilderland, Tax ID # 51.12-4-3.
A Clerical Error as defined by RPTL §550 (2) (c), has occurred. Mr. Timony is a veteran and has received a disability compensation rating from the United States Veteran’s Administration as a result of a service connected disability. The Alternative Veterans Exemption from Real Property Taxation, granted pursuant to RPTL §485-a, authorizes an additional tax exemptions for veterans with service connected disabilities. Due to a Clerical Error as defined by RPTL §550 (2) (c), the service connected disability exemption component was never granted to Mr. Timony.
Real Property Tax Law §556 allows for the correction of Clerical Errors made on the assessment and tax roll. I recommend that the Albany County Legislature approve the three correction applications and authorize a refund to Mr. Timony.
