AMENDING RESOLUTION NO. 147 FOR 2022, AS AMENDED, REGARDING CONSTRUCTION SERVICES FOR THE ALBANY COUNTY RAIL TRAIL OVER NEW SCOTLAND ROAD (SR 85) BRIDGE REPLACEMENT PROJECT

By Public Works Committee:
WHEREAS, By Resolution No. 147 for 2022, this Honorable Body authorized an agreement with Bette & Cring, LLC in the amount of $2,696,344 for construction services regarding the Albany County Rail Trail Over New Scotland Road (SR 85) Bridge Replacement Project for a term commencing April 1, 2022 and ending December 31, 2023, and
WHEREAS, By Resolution No. 76 for 2023, this Honorable Body amended the aforementioned agreement in the amount of $584,200 to complete additional work related to wall resurfacing along New Scotland Road (SR 85), for a new total amount of $3,280,544, and
WHEREAS, By Resolution No. 319 for 2023, this Honorable Body amended the aforementioned agreement in the amount of $346,000 in light of additional work needed to remove the damaged bridge on the Rail Trail and to facilitate construction of a temporary bridge, for a new total amount of 3,626,544, and
WHEREAS, The Commissioner of the Department of Public Works has requested a third amendment to the agreement with Bette & Cring, LLC in order to address soil remediation concerns discovered during excavation for a storm drain, in an amount not to exceed $84,917, for a term commencing May 1, 2024 and ending April 30, 2025, and
WHEREAS, The Commissioner has indicated that the soil is unsuitable for the drainage and must be removed and replaced with suitable material in order for the project to be completed, now, therefore, be it
RESOLVED, By the Albany County Legislature that Resolution No. 147 for 2022 is hereby amended to reflect a revised total amount of $3,711,461, and that the excavation, removal and replacement of unsuitable soil shall be included in the revised scope of work, and, be it further
