CONFIRMING THE APPOINTMENT OF THE ASSIGNED COUNSEL ADMINISTRATOR AND AUTHORIZING A WAIVER TO THE RESIDENCY REQUIREMENT FOR ALBANY COUNTY

WHEREAS, By Resolution No. 541 for 2023, this Honorable Body established a limited residency requirement for select positions in County government, including Commissioner and Director positions subject to confirmation by the Albany County Legislature, and
WHEREAS, The County Executive has indicated that, following a diligent search, no qualified candidates residing within Albany County were found, and
WHEREAS, The Personnel Committee of the Albany County Legislature has been satisfied that there exists a shortage of qualified Albany County residents to fill the position of Assigned Counsel Administrator and recommends that approval in accordance with the requirements of Resolution No. 541 for 2023 be granted, and
WHEREAS, The County Executive has recommended Shane Hug for appointment to the position of Assigned Counsel Administrator subject to confirmation by the Albany County Legislature pursuant to ? 302(c) of the Albany County Charter, and
WHEREAS, The County Executive has also requested to increase the salary for the position in order to attract qualified candidates following a recommendation to do so by the New York State Office of Indigent Legal Services now, therefore, be it
RESOLVED, By the Albany County Legislature that the consideration of out-of-county applicants to fill the position of Assigned Counsel Administrator is hereby granted in accordance with the requirements of Resolution No. 541 for 2023 in order to fill said position, and, be it further
RESOLVED, That the appointment of Shane Hug to the position of Assigned Counsel Administrator to serve at the pleasure of the County Executive with an annual salary of $124,000 is hereby confirmed, and, be it further
