RESOLUTION NO. 538

 

AUTHORIZING MODIFIED INSTALLMENT PAYMENT PLANS RELATED TO OUTSTANDING SCHOOL TAX BILLS ISSUED IN SEPTEMBER 2020

 

                     Introduced: 12/21/20

                     By Audit and Finance Committee:

 

WHEREAS, By Local Law 6 for 1995, as amended, this Honorable Body  authorized the issuance of installment payment plans for certain delinquent real property taxes, including a 5% penalty for late payment, and

 

WHEREAS, The Commissioner of the Department of Management and Budget has requested authorization to enter into modified installment payment plans for outstanding school tax bills issued in September 2020, with terms not to exceed six months commencing on or after January 1, 2021 and ending on June 30, 2021, and

 

WHEREAS, The Commissioner has recommended that such installment payment plans be modified to waive the five percent (5%) penalty imposed by New York State Real Property Tax Law §936, and

 

                     WHEREAS, This Body requests that the Department of Management and Budget come forward with a similar proposal for town school districts when those warrants come forward, now, therefore, be it

 

                     RESOLVED, That the County Executive is authorized to execute on behalf of the County any documents necessary to enter into modified installment payment plans for outstanding school tax bills issued in September 2020, with terms with terms not to exceed six months commencing on or after January 1, 2021 and ending on June 30, 2021 and, be it further

 

                     RESOLVED, That such modified installment payment plans shall reduce the interest rate by 5% in order to waive the penalty imposed pursuant to New York State Real Property Tax Law §936, and be it further

 

                     RESOLVED, That the County Attorney is authorized to approve said payment plans as to form and content, and, be it further

 

                     RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
