AMENDING RESOLUTION NO. 85 FOR 2022 REGARDING AUTHORIZATION TO CONVEY REAL PROPERTY LOCATED AT 138 FOURTH AVENUE (TAX MAP NO. 76.64-3-7), 53 LEXINGTON AVENUE (TAX MAP NO. 65.64-2-35), AND 140 CLINTON STREET (TAX MAP NO. 76.73-4-35) IN THE CITY OF ALBANY

 

                     Introduced: 6/13/22

                     By Audit and Finance Committee:

 

                     WHEREAS, The Law Department has requested a stylistic amendment to Resolution No. 85 for 2022, now, therefore, be it

 

                     RESOLVED, By the Albany County Legislature, that Resolution No. 85 for 2022 is hereby amended that all instances of “Clinton Avenue” be amended to “Clinton Street”, and that the third Resolved clause be amended to read as follows:

 

“RESOLVED, That Nia Prendergast and Karen Range shall be responsible for all closing costs, and “Any additional interest and penalties at the rate of 12% per annum computed to the date upon which the conveyance back of said properties is made by the County that have accrued on the delinquent taxes for these properties will be owed. The amount of all out-of-pocket costs and expenses incurred by the County in connection with said properties following the date of its foreclosure "in rem" by the County including, but not limited to, real property and school taxes, special assessments, municipal fees and charges, and maintenance and repairs shall be reimbursed to the County, and, be it further”

 

and, be it further

 

                     RESOLVED, That the County Attorney is authorized to approve said conveyance as to form and content, and, be it further

 

                     RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
