AMENDING RESOLUTION NO. 325 FOR 2020 REGARDING THE CONVEYANCE OF REAL PROPERTY LOCATED AT 2607 2ND AVENUE (TAX MAP NO. 32.8-3-9.1) IN THE TOWN OF COLONIE

By Audit and Finance Committee:
WHEREAS, By Resolution No. 324 for 2020, this Honorable Body authorized the conveyance of property located at 2607 2nd Avenue (Tax Map No. 32.8-3-9.1) in the Town of Colonie to Chei-Car Realty LLC, 888 Troy Schenectady Road, Latham, NY 12110, and
WHEREAS, The Commissioner of the Department of Management and Budget has requested an amendment in order to complete the conveyance, now, therefore, be it
RESOLVED, By the Albany County Legislature, that Resolution No. 325 for 2020 is hereby amended as follows:
By replacing all instances of “Chei-Car Realty LLC” with “Chel-Car Realty
LLC”, and
After the first resolved clause, add:
“RESOLVED, That Chel-Car Realty LLC shall be responsible for all prior water, sewer and municipal charges not in the collection process of the Albany County Division of Finance as of the date of the property closing, as well as any and all water, sewer, municipal charges, and real estate taxes (Property, School Taxes) billed on and after January 1, 2021, and, be it further”
and, be it further
RESOLVED, That the County Attorney is authorized to approve said conveyance as to form and content, and, be it further
RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
