AUTHORIZING THE CONVEYANCE OF REAL PROPERTY LOCATED AT STATE ROUTE 32 (TAX MAP NO. 152.00-2-40) IN THE TOWN OF WESTERLO

By Audit and Finance Committee:

WHEREAS, Around 1916, the State of New York constructed or improved State Route 32 in the Town of Westerlo, and

WHEREAS, In 1992, the State of New York reconstructed State Route 32 in the Town of Westerlo, and in doing so created land no longer needed by New York State for highway purposes, and pursuant to Official Order H2333 of the New York State Highway Department abandoned all titles and interests to the property, and

WHEREAS, This new parcel of property, now owned by the County of Albany located at State Route 32 in the Town of Westerlo (identified as Tax Map No. 152.00-2-40), has been added to the 2023 assessment roles for the Town, and

WHEREAS, John Dolce, an abutting property owner, has expressed an interest in acquiring this parcel for $1,500, and he intends to use it for parking and utilities for an abutting business, and

WHEREAS, By Resolution No. 437 for 2023, this parcel was declared "no longer necessary for public use" pursuant to County Law ? 215, and it is therefore eligible to be sold, now, therefore, be it

RESOLVED, By the Albany County Legislature that the County Executive is authorized to execute on behalf of the County any documents necessary to convey the parcel of real property known and identified as Tax Map No. 152.00-2-40 in the Town of Westerlo to John Dolce, 567 Hale Road, Rensselaerville, NY 12147 for $1,500, and, be it further

RESOLVED, That John Dolce shall be responsible for all closing costs as well as a pro-rated share of any and all current real-property taxes which are due at closing, and, be it further

RESOLVED, That the County Attorney is authorized to approve said conveyance as to form and content, and, be it further
