AUTHORIZING THE CONVEYANCE OF REAL PROPERTY LOCATED AT 770 ALBANY SHAKER ROAD (TAX MAP NO. 30.-2-13) IN THE TOWN OF COLONIE

WHEREAS, Heritage Park, located at 770 Albany Shaker Road (Tax Map No. 30.-2-13) in the Town of Colonie, is owned by the County of Albany, and

WHEREAS, The New York State Division of Military and Naval Affairs has expressed an interest in acquiring a portion of this parcel, and has offered to pay $4,567,500 for the property, and

WHEREAS, The County Executive's Office has indicated that the New York State Division of Military and Naval Affairs intends to develop this site as the new Division Headquarters for the New York Army National Guard 42nd Infantry Division, and

WHEREAS, By Resolution No. 622 for 2024, this portion of a parcel of real property located at 770 Albany Shaker Road (Tax Map No. 30.-2-13) in the Town of Colonie was deemed "no longer necessary for public use" pursuant to County Law ? 215 and ? 65-3 of the Albany County Code and is therefore eligible to be sold,

WHEREAS, This sale has been designated an Unlisted action pursuant to the State Environmental Quality Review Act (SEQRA), and

WHEREAS, The County Executive has indicated that a short Environmental Assessment Form has been completed and, after review, it has been recommended that the Project will not have a significant adverse impact on the environment, now, therefore, be it

RESOLVED, That the Albany County Legislature has considered the recommendation and materials submitted and hereby determines that this sale will not have a significant adverse impact on the environment and hereby issues a negative declaration pursuant to SEQRA, and, be it further
