DECLARING A PORTION OF 209 CHURCH STREET (TAX MAP NO. 87.7-1-4) IN THE CITY OF ALBANY NO LONGER NECESSARY FOR PUBLIC USE AND AUTHORIZING THE CONVEYANCE OF SAID PORTION TO THE ALBANY PORT DISTRICT COMMISSION

By Audit and Finance Committee:
WHEREAS, The County of Albany owns 209 Church Street (Tax Map No. 87.7-1-4) in the City of Albany, which is the location of the Albany County Water Purification District's South Plant, and is located next to the Port of Albany, and
WHEREAS, The Albany Port District Commission, which operates the port, has expressed an interest in acquiring a +0.043 acre portion of 209 Church Street, situated along the southeast portion of the parcel at the corner of Church Street and Boat Street and as indicated on the map annexed hereto, in order to continue with ongoing rail improvements for the Port of Albany, and
WHEREAS, The Albany Port District Commission has offered $8,000 for the portion of the parcel indicated, as well as to cover any and all closing costs, and
WHEREAS, The Albany County Water Purification District's Board of Commissioners have unanimously approved the sale of said portion of 209 Church Street, as it will have no adverse impact on their operations, now, therefore, be it
RESOLVED, By the Albany County Legislature, that pursuant to Local Law No. 2 of 1998, the Albany County Legislature hereby declares that the +0.043 acre portion of 209 Church Street as described in the map annexed hereto is "no longer necessary for public use" and, be it further
RESOLVED, That the County Executive is authorized to execute on behalf of the County any documents necessary to convey the portion of 209 Church Street (Tax Map No. 87.7-1-4) in the City of Albany as indicated on the map annexed hereto, to the Albany Port District Commission for the amount of $8,000, and
RESOLVED, That the Albany Port District Commission shall be responsible for all closing costs and all taxes, ...
