DETERMINATION THAT THE ALBANY COUNTY RAIL TRAIL BRIDGE REHABILITATION PROJECT WILL NOT HAVE A SIGNIFICANT EFFECT ON THE ENVIRONMENT

By Audit and Finance Committee:

WHEREAS, Pursuant to Resolution No. 81 for 2019 this Honorable Body authorized the Department of Public Works and the Department of Economic Development, Conservation, and Planning ("Planning Department") to take initial review actions in order to seek lead agency status regarding the Albany County Rail Trail Bridge over SR 85 (New Scotland Road) Bridge Replacement project, including providing the required notice to all interested parties, and

WHEREAS, By Resolution No. 230 for 2019 this Honorable Body declared Albany County as the lead agency for the Project and designated the Project as a Type I action in order to comply with the regulations found under the State Environmental Quality Review Act ("SEQRA"), and

WHEREAS, Under Part 617 of Title 6 of the New York Code of Rules and Regulations, and because the project has been designated a Type I action, it is now necessary for Albany County to make a determination regarding the potential environmental impact of the Project, and

WHEREAS, The Commissioner of the Department of Public Works has indicated that a full Environmental Assessment has been completed by M.J. Engineering and Land Surveying, P.C. which has determined that the Project will not have a significant impact on the environment and is therefore properly classified as a negative declaration under SEQRA, now, therefore be it

RESOLVED, By the Albany County Legislature that this Honorable Body has considered the findings contained within the full Environmental Assessment and, pursuant to SEQRA, hereby determines that the Project will not have a significant impact on the environment and is therefore properly classified as a Type I action with a negative declaration, and, be it further
