AUTHORIZING A UTILITY EASEMENT AGREEMENT WITH NIAGARA MOHAWK POWER CORPORATION REGARDING THE INSTALLATION OF UTILITIES ON PROPERTY LOCATED AT 51 SOUTH PEARL STREET FOR THE MVP ARENA PARKING GARAGE SOLAR ARRAY PROJECT

WHEREAS, The County Executive has requested authorization to enter into a utility easement agreement with the Niagara Mohawk Power Corporation regarding the installation of utilities on property located at 51 South Pearl Street for a fee of $1.00 to remain in effect in perpetuity with the property, and
WHEREAS, The County Executive has indicated that this easement is necessary to allow for the installation of utility-owned infrastructure necessary to support the MVP Arena Parking Garage Solar Array Project, now, therefore, be it
RESOLVED, By the Albany County Legislature that the County Executive is authorized to enter into a utility easement agreement with the Niagara Mohawk Power Corporation, Syracuse, NY 13202 regarding the installation of utilities on property located at 51 South Pearl Street for a fee of $1.00 to remain in effect in perpetuity with the property, and, be it further
RESOLVED, That the County Attorney is authorized to approve said utility easement agreement as to form and content, and be it further
RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
