AUTHORIZING A LICENSE AGREEMENT WITH STEWART'S SHOPS CORP. REGARDING THE USE OF PROPERTY AT 309 DELAWARE AVENUE IN THE TOWN OF DELMAR

By Audit and Finance Committee:

WHEREAS, By Resolution No. 326 for 2017, as amended by Resolution No. 429 for 2017, this Honorable Body authorized a license agreement with Stewart's Shops Corp. for use of the rear portion of the parking lot in the amount of $6,000 per year for a total amount of $18,000 over a three-year term commencing September 1, 2017 and ending August 31, 2020, with three three-year options to renew, and

WHEREAS, By Resolution No. 369 for 2020, this Honorable Body authorized the execution of the first of three options to renew the license agreement in the amount of $6,000 per year for a total amount of $18,000 over a three-year term commencing September 1, 2020 and ending August 31, 2023, and

WHEREAS, The County Executive has requested authorization to exercise the second of three options to renew the license agreement to allow for the continued use of the rear portion of the parking lot of the Stewart's Shop that encroaches upon the Albany County Rail Trail in the amount of $6,000 per year for a total amount of $18,000 over a three-year term commencing September 1, 2023 and ending August 31, 2026, now, therefore, be it

RESOLVED, By the Albany County Legislature that the County Executive is authorized to enter into a license agreement with Stewart's Shops Corp., Saratoga Springs, NY 12866 regarding the use of the rear portion of the parking lot in the amount of $6,000 per year for a total amount of $18,000 over a three-year term commencing September 1, 2023 and ending August 31, 2026, and, be it further

RESOLVED, That said agreement may be terminated on 90 days' notice by either party, and, be it further
