DECLARING ALBANY COUNTY AS LEAD AGENCY FOR THE PURPOSE OF STATE ENVIRONMENTAL QUALITY REVIEW FOR THE SOLAR INSTALLATION AT 897 WATERVLIET-SHAKER ROAD (THE RADAR TOWER)

By Conservation, Sustainability, and Green Initiatives Committee and Mr. Miller:
WHEREAS, The County Executive has proposed to undertake the solar installation project at 897 Watervliet-Shaker Road (The Radar Tower), and
WHEREAS, Under Part 617 of Title 6 of the New York Code of Rules and Regulations, the State Environmental Quality Review Act (“SEQRA”), it is necessary for a lead agency to be established for the review of the Project and for the action to be classified as Type I, Type II or unlisted, and
WHEREAS, Due to historical concerns regarding the site, the action is considered a Type I action pursuant to SEQRA and requires that a Lead Agency be designated, and
WHEREAS, Albany County, as the government agency undertaking the Project for the benefit of the health, safety, and welfare of Albany County residents is the suitable agency for undertaking, funding and approving the project, now, therefore be it
RESOLVED, That Albany County hereby declares itself Lead Agency for the environmental review of the Project pursuant to SEQRA, and, be it further
RESOLVED, That Albany County, as the Lead Agency pursuant to SEQRA, has classified the above action for the Project as a Type I action pursuant to SEQRA §617, and, be it further
RESOLVED, That the Chair of the Legislature is hereby authorized and directed to sign and file any documents that may be necessary to comply with SEQRA regarding the Project, and, be it further
RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
