DECLARING A PARCEL OF REAL PROPERTY LOCATED AT TAX MAP NO. 152.00-2-40 IN THE TOWN OF WESTERLO NO LONGER NECESSARY FOR PUBLIC USE

By Audit and Finance Committee:
WHEREAS, Around 1916, the State of New York constructed or improved State Route 32 in the Town of Westerlo, for which the County of Albany acquired a highway right-of-way, and
WHEREAS, In 1992, the State of New York reconstructed and relocated State Route 32 and, in doing so, created land no longer needed by New York State for highway purposes, and
WHEREAS, In a letter dated August 4, 1994 and pursuant to Official Order H2333 of the New York State Highway Department, the State of New York abandoned all titles, interests, and obligation to the property, and
WHEREAS, Due to an error, this land was never assigned a parcel Tax Map Number and, in 2022, this parcel was created, identified as Tax Map No. 152.00-2-40, and added to the 2023 assessment roles for the Town of Westerlo, and
WHEREAS, The County Executive has requested that this new parcel, measuring +1.84 acres, be deemed no longer necessary for public use so that the County may sell the property consistent with § 65-3 of the Albany County Code, now, therefore, be it
RESOLVED, By the Albany County Legislature, that pursuant to § 65-3 of the Albany County Code, the Albany County Legislature hereby declares that the property located at Tax Map No. 152.00-2-40 in the Town of Westerlo and as described in the map annexed hereto, is “no longer necessary for public use” and, be it further
RESOLVED, That the County Attorney is authorized to approve said document as to form and content, and, be it further
RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
