AMENDING RESOLUTION NO. 153 FOR 2025 REGARDING ELECTRICITY SUPPLY TO VARIOUS COUNTY FACILITIES

WHEREAS, By Resolution No. 153 for 2025, this Honorable Body authorized the second of two renewal options to an agreement with Direct Energy Business, LLC regarding the supply of electricity to various County facilities for a term commencing August 1, 2025 and ending July 31, 2026, and
WHEREAS, The Albany County Energy Advisory Group has requested an amendment to this agreement to provide an eight-month extension to the contract with Direct Energy Business, LLC for the supply of electric services to various County facilities, and
WHEREAS, Market volatility has caused market rates to rapidly increase and the approval timeline for a Request for Proposals in this volatile market could subject the County to unnecessarily high rates for electric service over the long term, and
WHEREAS, This amendment will also provide the County additional time to evaluate the energy needs of the newly acquired buildings on the former St. Rose College campus, now, therefore be it
RESOLVED, By the Albany County Legislature that Resolution No. 153 for 2025 is hereby amended to reflect a new term ending date of March 31, 2027 rather than July 31, 2026, and, be it further
RESOLVED, That the County Attorney is authorized to approve said amendment as to form and content, and, be it further
RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
