RESOLUTION NO. 203

AUTHORIZING A RENEWAL AGREEMENT WITH NEW YORK STATE OFFICE OF GENERAL SERVICES REGARDING THE PROVISION OF COOLING WATER AT THE MVP ARENA

WHEREAS, The General Manager of the MVP Arena has requested authorization to enter into an agreement with the New York State Office of General Services (OGS) regarding the provision of cooling water to the MVP Arena in an approximate amount of $63,000 annually for a term commencing August 1, 2019 and ending July 31, 2029, and

WHEREAS, The General Manager has indicated that the river water supplied by OGS is provided at a much lower rate than other options available to the MVP Arena, and the renewal lease will include the same rates as the prior lease for the duration of its term, and

WHEREAS, The General Manager has also indicated that the County has agreed to maintain a twenty inch County supply main from the State’s forty-eight inch primary supply main running from the station to the Empire State Plaza, and shall pay costs incurred for repair or replacement of any part of the County supply main, including the tapping valve, now, therefore, be it

RESOLVED, By the Albany County Legislature that the County Executive is authorized to enter into an agreement with OGS regarding the provision of cooling water at the MVP Arena in an approximate amount of $63,000 annually for a term commencing August 1, 2019 and ending July 31, 2029, and, be it further

RESOLVED, That the County Attorney is authorized to approve said lease agreement as to form and content, and, be it further

RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
