AUTHORIZING A LEASE AGREEMENT FOR LAND BEING USED FOR A WIRELESS COMMUNICATIONS FACILITY

By Public Safety Committee:

WHEREAS, By Resolution No. 410 for 2015, this Honorable Body authorized a ten-year lease agreement with William Biers for the lease of property for the construction of a radio tower at 319 Biers Road in the Town of Coeymans for use by the Sheriff's Office 911 Dispatch Center, and

WHEREAS, By Resolution No. 78 for 2016, this Honorable Body declared the County-wide Public Safety Radio Communications System immune from local regulation, and

WHEREAS, The Sheriff has requested authorization to enter into a five-year agreement with William Biers for the lease of property located at 216 Biers Road (Tax Map No. 142.-1-11.1) and a parcel of property located on Biers Road (Tax Map No. 142.-1-12) in the Town of Coeymans for use as a wireless communications facility, and

WHEREAS, The rent payable from Albany County for the term commencing May 1, 2024 and ending April 30, 2029, is as follows:

Year 1: $27,000 annually
Year 2: $27,810 annually
Year 3: $28,644 annually
Year 4: $29,504 annually
Year 5: $30,389 annually

WHEREAS, The lease agreement includes four five-year options to renew with rent increasing 3% annually, now, therefore, be it

RESOLVED, By the Albany County Legislature that the County Executive is authorized to enter into a five-year agreement with William Biers for the lease of property located at 216 Biers Road (Tax Map No. 142.-1-11.1) and a parcel of property located on Biers Road (Tax Map No. 142.-1-12) in the Town of Coeymans for use as a wireless communications facility for a term commencing May 1, 2024 and ending April 30, 2029, with four five-year options to renew, and, be it further
