AUTHORIZING AN AGREEMENT WITH THE NEW YORK STATE DEPARTMENT OF AGRICULTURE AND MARKETS REGARDING FUEL SAMPLE TESTING AND INSPECTION AT RETAIL FUEL OUTLETS

By Public Works Committee:

WHEREAS, The Commissioner of the Department of General Services has requested authorization to enter into an agreement with the New York State Department of Agriculture and Markets regarding fuel sample testing and inspection at retail fuel outlets in an amount not to exceed $16,445 per year for a total amount not to exceed $82,225 over a five-year term commencing April 1, 2024 and ending March 31, 2029, and 

WHEREAS, Pursuant to New York State Agriculture and Markets Law and as administered and enforced by the New York State Department Agriculture and Markets’ Petroleum Quality Program, Albany County Weights and Measures officials will conduct inspections, perform screening tests, and sample petroleum products in transport or held, kept, or stored in a storage tank located at retail fuel outlet in Albany County, now, therefore, be it

RESOLVED, By the Albany County Legislature that the County Executive is authorized to enter into an agreement with the New York State Department of Agriculture and Markets regarding fuel sample testing and inspection at retail fuel outlets in an amount not to exceed $16,445 per year for a total amount not to exceed $82,225 over a five-year term commencing April 1, 2024 and ending March 31, 2029, and, be it further

RESOLVED, That the County Attorney is authorized to approve said agreement as to form and content, and, be it further

RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
