AMENDING RESOLUTION NO. 262 FOR 2022 DIRECTING THE BOARD OF ELECTIONS TO CERTIFY ITS EXPENSES REGARDING THE 2021 ELECTION CYCLE

WHEREAS, Section 4-138 of New York State Election Law provides for a mechanism allowing County Legislatures to direct County Boards of Elections to certify total election expenses of said boards in any given year, and

WHEREAS, Pursuant to Section 4-138, the County Legislature may direct the Board of Elections to certify the portion of expenses to be borne by the municipalities within the County, and

WHEREAS, By Resolution No. 262 for 2022, this Honorable Body authorized and directed the Albany County Board of Elections to certify the expenses to be borne by any municipalities in Albany County as outlined by Section 4-138 of New York State Election Law, and

WHEREAS, The Commissioners of the Board of Elections have requested that Resolution No. 262 for 2022 be amended to more equitably distribute costs by voting population for the early voting period, now, therefore, be it

RESOLVED, That the Albany County Legislature authorizes and directs the Albany County Board of Elections to certify the expenses to be borne by any municipalities in Albany County as outlined by Section 4-138 of New York State Election Law, and, be it further
RESOLVED, The Albany County Legislature authorizes and directs the Albany County Board of Elections to certify to the Clerk of the Legislature such expenses for the year 2021 pursuant to the spreadsheet annexed hereto, and, be it further
RESOLVED, That the County shall be paid for such expenses no later than January 31, 2023 or those expenses will be charged against other monies due any municipality which has not made payment by that date, and, be it further
