AUTHORIZING THE CONVEYANCE OF COUNTY PROPERTY BY QUITCLAIM DEED AND EASEMENT TO MOHAWK HUDSON LAND CONSERVANCY REGARDING THE BENDER MELON FARM PRESERVE BRIDGE OVER THE ALBANY COUNTY RAIL TRAIL

By Audit and Finance Committee:
WHEREAS, The Albany County Rail Trail stretches nine miles between the Port of Albany and Voorheesville, a portion of which is located at Tax Map No. 73.-5-1 in the Town of New Scotland, and
WHEREAS, A parcel located at 306 Maple Road (Tax Map No. 73.-4-12.1) borders along both sides of this portion of the Rail Trail, and is connected by a steel bridge known as the Bender Melon Farm Preserve Bridge, and
WHEREAS, The Mohawk Hudson Land Conservancy ("MHLC"), the abutting owner of the parcel located at 306 Maple Road, has expressed an interest in acquiring this structure for $1, and intends to renovate and reopen the bridge to connect both parcels for use by hikers, cyclists, and light emergency vehicles, and
WHEREAS, The County Executive has requested authorization to transfer by quitclaim deed any and all rights and interests to the bridge to MHLC, and grant an easement to MHLC to access the Rail Trail to accomplish any necessary improvements to the Bender Melon Farm Preserve Bridge, now, therefore, be it
RESOLVED, By the Albany County Legislature that the County Executive is authorized to execute on behalf of the County any documents necessary to convey by quitclaim deed and easement any and all rights and interests to the Bender Melon Farm Preserve Bridge located at parcel Tax Map No. 73.-5-1 in the Town of New Scotland to the Mohawk Hudson Land Conservancy, Inc. Delmar, NY 12054 for the amount of $1, and, be it further
RESOLVED, That the County Attorney is authorized to approve said conveyance as to form and content, and, be it further
