RESOLUTION NO. 397

 

AUTHORIZING A ROAD USE AND CROSSING AGREEMENT WITH CHAMPLAIN HUDSON POWER EXPRESS, LLC FOR CONSTUCTION OF A BURIED HIGH VOLTAGE DIRECT CURRENT LINE

WHEREAS,                      The Commissioner of the Department of Public Works has requested authorization to enter into an agreement with Champlain Hudson Power Express, LLC (CHPE) for construction of a buried high voltage direct current electric transmission line for the term commencing November 1, 2023 and ending November 1, 2024, and

 

WHEREAS, The Commissioner has indicated that the transmission line will be buried under approximately 1.75 miles of CR53 (South Albany Road) and CR54 (Bells Crossing) and will cross under CR201 and CR306 in Voorheesville, and CR308 in the Town of New Scotland, and

 

WHEREAS, The Commissioner has also indicated that this agreement will indemnify the County and provide $10,000 in an escrow account that can be used at the County’s discretion toward items including, but not limited to, inspection of the work completed by CHPE, now, therefore, be it

 

RESOLVED, By the Albany County Legislature that the County Executive is authorized to enter into an agreement with CHPE, New York, NY 10022, for construction of a buried high voltage direct current electric transmission line for the term commencing November 1, 2023 and ending November 1, 2024, and, be it further

 

RESOLVED, That the Albany County Attorney is authorized to approve said agreement as to form and content, and, be it further

 

RESOLVED, That the Clerk of the County legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
