RESOLUTION NO. 207
AUTHORIZING THE CONVEYANCE OF A PORTION OF REAL PROPERTY KNOWN AS OLD COUNTY ROUTE 401 LOCATED IN THE TOWN OF WESTERLO

By Audit and Finance Committee:
WHEREAS, The County of Albany is the owner of a portion of real property known as Old County Route 401 in the Town of Westerlo, which is part of the Albany County Highway System, and
WHEREAS, The Town of Westerlo has expressed an interest in acquiring said parcel from Albany County in the amount of $1, and
WHEREAS, The Commissioner of the Albany County Department of Public Works has indicated that Old County Route 401 was realigned many years ago, and that while this section of road no longer complies with County standards, it does meet standards set by the Town of Westerlo, and
WHEREAS, By Resolution No. 206 for 2024, this portion of real property was deemed “no longer necessary for public use” pursuant to County Law § 215 and § 65-3 of the Albany County Code and is therefore eligible to be sold, now, therefore, be it
RESOLVED, By the Albany County Legislature that the County Executive is authorized to execute on behalf of the County any documents necessary to convey the portion of real property known as Old County Route 401, Westerlo, NY to the Town of Westerlo for the amount of $1, and, be it further
RESOLVED, That the County Attorney is authorized to approve said conveyance as to form and content, and, be it further
RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
