RESOLUTION NO. 533

 

AUTHORIZING A LICENSE AGREEMENT WITH THE MOHAWK HUDSON LAND CONSERVANCY REGARDING A PHYSICAL CONNECTION BETWEEN THE ALBANY COUNTY RAIL TRAIL AND THE NOONAN PRESERVE IN THE CITY OF ALBANY

                     By Conservation, Sustainability, and Green Initiatives Committee and Mr. Miller:

 

                     WHEREAS, The Albany County Executive has requested authorization to enter into an agreement with the Mohawk Hudson Land Conservancy (MHLC) regarding a physical connection between the Albany County Rail Trail and the Noonan Preserve in the City of Albany, and

 

WHEREAS, The County Executive has indicated that the Albany County Department of Public Works will provide transportation and drivers for the MHLC staff and volunteers to ensure the highest level of safety as only County-owned vehicles will be driving on the County Rail Trail, and

 

WHEREAS, The County Executive has also indicated that a physical connection will allow for a safe transition for pedestrians and bicycles, as well as indemnify the County from liability, now, therefore, be it

 

                     RESOLVED, By the Albany County Legislature that the County Executive is authorized to enter into an agreement with the MHLC regarding a physical connection between the Albany County Rail Trail and the Noonan Preserve in the City of Albany, and, be it further

 

                     RESOLVED, That the County Attorney is authorized to approve said agreement as to form and content, and, be it further

 

                     RESOLVED, That the Clerk of the County Legislature is directed to forward certified copies of this resolution to the appropriate County Officials.
