AUTHORIZING AN AGREEMENT WITH SPRINT COMMUNICATIONS COMPANY, L.P. REGARDING RELOCATION OF BURIED FIBER OPTIC LINES ALONG THE ALBANY COUNTY RAIL TRAIL BRIDGE OVER NEW SCOTLAND ROAD (SR 85)

WHEREAS, By Resolution No. 495 for 2021, this Honorable Body authorized the execution of all necessary agreements, certifications, or reimbursement requests on behalf of the County of Albany with the New York State Department of Transportation in connection with the implementation of drainage improvements as part of the Albany County Rail Trail Bridge over New Scotland Road (SR 85) Project, and
WHEREAS, The Commissioner of the Department of Public Works has requested authorization to enter into an agreement with Sprint Communications Company, L.P. for the relocation of buried fiber optic lines along the length of the existing Albany County Rail Trail Bridge over New Scotland Road (SR 85) in an amount not to exceed $250,000 for a term commencing May 1, 2022 and ending December 31, 2023, and
WHEREAS, The Commissioner has indicated that the fiber optic lines will be temporarily relocated onto utility poles prior to removal of the existing structure, and once the new pedestrian bridge is complete, the fiber optic lines will be secured to the outside of the new structure, now, therefore, be it
RESOLVED, By the Albany County Legislature that the County Executive is authorized to enter into an agreement with Sprint Communications Company, L.P., Overland Park, KS 66251 for the relocation of buried fiber optic lines along the length of the existing Albany County Rail Trail Bridge over New Scotland Road (SR 85) in an amount not to exceed $250,000 for a term commencing May 1, 2022 and ending December 31, 2023, and, be it further
